Terms and Conditions of Kodo GmbH

1. Scope of Application and Provider

These General Terms and Conditions (“GTC”) govern the use of the money transfer services (“Service” or “Services”) of:

Kodo provides money transfer services in accordance with Swiss law and the requirements of the self-regulatory organisation (SRO) PolyReg.

The website www.kodopay.ch is for informational purposes only.

By signing the transaction receipt at the premises or at a distribution partner, you agree to these GTC.


2. Nature of the Service

Kodo enables physical money transfers from Switzerland to abroad.

Payouts are made:

Payouts are generally made in the local currency of the recipient country.

Kodo does not offer online transfers, long-term custody of funds, or escrow services.


3. Contract Formation and Process

A money transfer contract is concluded when you:

You will receive a receipt containing details of the amount, fees (if any), exchange rates, destination country, and availability.

You are solely responsible for informing the recipient about the money transfer.


4. Identification (KYC) and Beneficial Ownership

To use the Service, you must:

Kodo may request additional information (e.g. source of funds, purpose of the transaction).

If information is missing or insufficient, Kodo may refuse the transaction.


5. Fees and Exchange Rates

5.1

Kodo may charge a transfer fee in accordance with the applicable fee schedule. Any fees will be disclosed to you before completion of the transaction.

5.2

Where payouts are made in a different currency, a currency exchange will be applied at an exchange rate that may include a margin. This margin constitutes a source of income for Kodo and/or its partners.

5.3

In some countries, the final exchange rate may only be determined at the time of payout.

5.4

Local additional fees (e.g. mobile money fees, bank fees) may arise and are borne by the sender or the recipient.


6. Execution and Availability

Payouts are generally made within a reasonable timeframe.

Delays may occur due to:

Kodo does not guarantee immediate payout.


7. Payout in the Recipient Country

To collect the funds, the recipient may be required to:

Kodo’s obligation is deemed fulfilled once the amount has been paid out to a person who has been identified as entitled using reasonable care.


8. Obligations of the Sender

You are responsible for:

Kodo is not liable for goods or services paid for using the transfer.


9. Restrictions and Refusal

Kodo may refuse or delay transactions, in particular in cases of:

Statutory reporting obligations to authorities remain reserved.


10. Liability

Kodo is liable for damages caused by intent or gross negligence.

11. Cancellation and Refunds

A transaction may only be cancelled prior to payout.

If the payout has not yet occurred, the nominal amount will be refunded.

Whether fees are refunded depends on the individual case.

Once the payout has been completed, refunds are excluded.

14. Final Provisions

Swiss law shall apply.

The place of jurisdiction is Zurich, to the extent permitted by law.

Kodo may update these GTC at any time. The version published at the relevant time shall apply.
